1. Agreement to Terms

These Terms of Use ("Terms") govern your use of the Size Notes mobile application ("App") developed by Anorld Mukone ("Developer", "we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not download or use the App.

2. License to Use

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to use the App on devices you own or control, solely for your personal, non-commercial purposes, and in accordance with these Terms and the rules of the applicable app store (Apple App Store or Google Play).

This license does not include the right to:

• Sell, resell, or sublicense the App or any content within it;
• Modify, reverse-engineer, decompile, or disassemble the App;
• Use the App to develop a competing product or service;
• Remove or circumvent any license or copy-protection mechanisms.

3. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. User Content and Responsibility

All information you store in the App — names, measurements, photos — is entirely your own. You are solely responsible for:

• Ensuring you have the right to store information about other individuals (e.g., obtaining their consent);
• The accuracy of the measurements and data you enter;
• Any decisions made based on that data (including purchasing decisions).

You agree not to use the App to store, share, or transmit information in a way that is unlawful, harmful, defamatory, obscene, or violates the privacy rights of others.

5. QR Code and Data Sharing

The App allows you to share profile data with others via QR codes or text links. By using the sharing features, you confirm that:

• You have the consent of the person whose measurements you are sharing;
• You are sharing data voluntarily and understand it may be viewable by the recipient;
• We are not responsible for how recipients use the shared data.

6. In-App Purchases

"Size Notes Pro" is an optional one-time in-app purchase that unlocks unlimited profiles. All purchases are processed by Apple or Google and are subject to their respective terms. All purchases are final except where required by applicable law or the refund policies of Apple or Google.

If you delete and reinstall the App, you may restore your purchase at no additional charge using the "Restore Purchases" feature.

7. AI Gift Finder

The Gift Finder feature generates text prompts based on stored measurement data that you can send to third-party AI services. We make no representations or warranties regarding the accuracy, suitability, or availability of AI-generated gift suggestions. Use of third-party AI services is governed by the terms and privacy policies of those services, not ours. We are not responsible for purchases made based on AI suggestions.

8. Intellectual Property

The App, including its design, graphics, code, features, and branding, is owned by the Developer and protected by copyright, trademark, and other intellectual property laws. The "Size Notes" name and logo are proprietary to the Developer.

You may not use our trademarks, logos, or branding without prior written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the App will be error-free or uninterrupted; (b) measurements stored in the App are accurate reflections of a person's actual size; (c) gift purchases based on App data will result in a perfect fit.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the App;
• Any purchases made based on information stored in the App;
• Unauthorised access to or alteration of your data;
• Any other matter relating to the App.

Our total liability to you shall not exceed the amount you paid for the App (i.e. the price of the Pro upgrade, if purchased, or zero if you use only the free tier).

11. Third-Party Services

The App may integrate with or link to third-party services (e.g., AI services used with Gift Finder, app stores for purchasing). We are not responsible for the content, privacy practices, or terms of such services. Your use of third-party services is at your own risk.

12. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to discontinue the App or update it in any way at our discretion. In the event the App is discontinued, you will retain any locally stored data until you delete the App.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the Developer is based, without regard to conflict-of-law provisions. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or a court of competent jurisdiction.

14. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date. Continued use of the App after a change constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
